Terms and Conditions
1. General
These Terms & Conditions govern the sale of products, software, subscriptions, training, and support services supplied by FotoFinder South Africa (“the Company”). By purchasing or using our products and services, you agree to these terms.
2. Pricing and Payment
All prices are quoted in South African Rand (ZAR) unless otherwise stated and may be subject to VAT. Payment terms will be specified on quotations and invoices. Ownership of equipment remains with FotoFinder South Africa until full payment has been received.
3. Delivery and Installation
Delivery and installation dates are estimates and may be subject to factors beyond our control. Customers are responsible for ensuring that their premises meet the necessary requirements for installation and operation of the equipment.
4. Warranty
Products are covered by the manufacturer’s warranty, subject to the applicable warranty terms and conditions. The warranty does not cover damage resulting from misuse, unauthorized repairs, power surges, negligence, or normal wear and tear.
5. Software and Subscriptions
Certain products and features may require ongoing software subscriptions. Subscription fees, renewal terms, and cancellation policies will be communicated at the time of purchase. Continued access to subscription-based services is subject to payment of applicable fees.
6. Technical Support and Training
Technical support and training services may be provided remotely or on-site. Additional charges may apply for on-site support, travel, or training beyond the scope included with the original purchase.
7. Clinical Responsibility
Any artificial intelligence (AI), analysis software, or diagnostic support tools supplied by FotoFinder South Africa are intended to assist healthcare professionals and do not replace clinical judgement. The healthcare practitioner remains solely responsible for patient assessment, diagnosis, treatment decisions, and patient management.
8. Limitation of Liability
To the maximum extent permitted by law, FotoFinder South Africa shall not be liable for any indirect, consequential, or incidental losses, including loss of profits, business interruption, or data loss arising from the use of its products or services.
FotoFinder GmbH and FotoFinder South Africa will be exonerated from all and any liability, particularly medical liability resulting from the use of their products, dating back into the past or into the future.
The purchaser and user of FotoFinder solutions undertakes to use our products as an aid to diagnosis and is solely responsible for the diagnosis and treatment advice prescribed.
9. Data Protection
Customers are responsible for ensuring compliance with applicable data protection and privacy legislation, including POPIA, when using our products and services. Any personal information processed by FotoFinder South Africa will be handled in accordance with applicable privacy laws.
10. Governing Law
These Terms & Conditions are governed by the laws of South Africa. Any disputes arising from the use of our products or services shall be subject to the jurisdiction of the South African courts.
11. Changes to Terms
FotoFinder South Africa reserves the right to update these Terms & Conditions at any time. The latest version will always be available on our website.
